Please read these Terms of Service ("Terms") carefully before using the services of Unlimited Cheap Talk Wireless ("we," "our," or "us"). By using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing our website, visiting our physical location, or using our repair, wireless, or product services, you agree to comply with and be bound by these Terms of Service. If you do not agree with any part of these Terms, you may not use our services.

2. Services Offered

Unlimited Cheap Talk Wireless provides:

• Smartphone and tablet repair services
• Prepaid wireless service plans
• Phone and accessory sales
• Device activation and number porting
• Mobile repair services (on-site)

3. Repair Services Terms

3.1 Service Estimates

All repair prices are estimates unless otherwise stated. Final pricing may vary based on:

• Device model and condition
• Parts availability and cost
• Complexity of repair
• Additional issues discovered during repair

We will notify you before proceeding with any repair that exceeds the original estimate by more than 20%.

3.2 Diagnostic Fees

Diagnostic fees may apply for certain repairs. If you proceed with the repair, diagnostic fees are typically waived or applied toward the repair cost.

3.3 Data Loss Disclaimer

IMPORTANT: While we take precautions to preserve your data, we are not responsible for data loss during repairs. We strongly recommend backing up your device before any repair service. You acknowledge that data loss may occur and release us from liability for any data loss.

3.4 Warranty

Repairs are covered by our warranty policy as follows:

• Standard warranty: 30 days from repair completion
• Extended warranties may be available for additional cost
• Warranty covers defects in parts and workmanship
• Warranty does not cover: accidental damage, water damage after repair, normal wear, unauthorized modifications, or damage caused by misuse

3.5 Unrepairable Devices

If your device cannot be repaired or repair costs exceed device value, we will inform you before proceeding. You are not obligated to proceed with repairs that exceed device value.

4. Wireless Service Terms

4.1 Prepaid Plans

Prepaid plans are subject to:

• Payment in advance
• No contracts or credit checks
• Service terms and conditions of the underlying carrier network
• Network availability and coverage limitations

4.2 Plan Features

"Unlimited" plans may be subject to:

• Data deprioritization after certain usage thresholds
• Video streaming quality limitations
• Hotspot data limits
• Network management practices

Specific plan details will be provided at time of purchase.

4.3 Number Porting

Number porting is subject to:

• Account verification with previous carrier
• Account must be active and in good standing
• Porting typically completes within 2-4 hours but may take up to 48 hours
• We are not responsible for delays caused by previous carrier

4.4 Refunds and Cancellations

Prepaid plan payments are non-refundable once service is activated. Unused service time expires according to plan terms. Cancellations do not entitle you to refunds for unused service.

5. Product Sales Terms

5.1 Product Availability

Product availability is subject to change. We reserve the right to limit quantities and refuse sales. Prices are subject to change without notice.

5.2 Returns and Exchanges

Returns and exchanges are subject to:

• Items must be returned within 14 days of purchase
• Items must be unused, in original packaging, with receipt
• Opened software, cases, or accessories may not be returnable
• Refunds will be issued in original payment method
• Restocking fees may apply

5.3 Product Warranties

Products are covered by manufacturer warranties. We facilitate warranty claims but are not responsible for manufacturer warranty terms.

6. Payment Terms

We accept cash, credit cards, debit cards, and mobile payment methods. All prices are in U.S. dollars. Sales tax applies where required by law.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our liability for any claim arising from our services is limited to the amount you paid for the specific service
• We are not liable for indirect, incidental, special, consequential, or punitive damages
• We are not liable for loss of data, profits, or business opportunities
• We are not liable for delays caused by parts availability, carrier issues, or circumstances beyond our control

8. Indemnification

You agree to indemnify and hold harmless Unlimited Cheap Talk Wireless, its owners, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our services or violation of these Terms.

9. Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of Unlimited Cheap Talk Wireless or its licensors and is protected by copyright and trademark laws.

10. Prohibited Uses

You agree not to:

• Use our services for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our services
• Use our services to transmit harmful code or malware
• Impersonate or misrepresent your affiliation with us

11. Dispute Resolution

Any disputes arising from these Terms or our services will be resolved through:

1. Good faith negotiation
2. If negotiation fails, binding arbitration in accordance with the rules of the American Arbitration Association
3. Arbitration will take place in DeKalb County, Georgia

You waive your right to a jury trial and to participate in class action lawsuits.

12. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after changes constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and Warranty Policy, constitute the entire agreement between you and Unlimited Cheap Talk Wireless regarding our services.
